This Privacy Policy (this "Policy") describes how E-Z Storage LLC, an Arizona limited liability company ("Company," "we," "us," or "our"), collects, uses, discloses, retains, and protects Personal Data (as defined herein) when you access or use our website, purchase our products, or engage with our services (collectively, the "Service"). Please read this Policy carefully before using the Service.

Your Agreement to This Policy

By accessing or using the Service, you acknowledge that you have read and understood this Policy and agree to the collection, use, and disclosure of your Personal Data as described herein. If you do not agree, you must discontinue use of the Service immediately.

1. Legal Effect; Hierarchy of Documents

This Policy is incorporated into and forms part of the E-Z Storage LLC Master Service Agreement. In the event of any conflict between applicable law, a separately signed written agreement, the Company's Terms and Conditions, and this Privacy Policy, the documents govern in the following order of precedence, with (a) taking highest precedence:

  1. (a) Applicable federal and state law
  2. (b) A separately executed written agreement between the Parties
  3. (c) The E-Z Storage LLC Master Service Agreement and Terms and Conditions
  4. (d) This Privacy Policy

2. Definitions

As used in this Policy, the following terms have the meanings set forth below:

  • "Personal Data" means any information that identifies, relates to, describes, or could reasonably be linked to an identifiable individual, including name, contact information, purchase history, and device identifiers.
  • "Sensitive Personal Data" means Personal Data defined as sensitive under applicable law, including account credentials, precise geolocation data, and certain financial information.
  • "Sale" or "Sharing" means disclosure of Personal Data for monetary or other valuable consideration, including cross-context behavioral advertising where defined by applicable law.
  • "Targeted Advertising" means displaying advertisements based on Personal Data obtained from activities over time and across nonaffiliated websites or online services.
  • "Processor" or "Service Provider" means a third party that processes Personal Data on Company's behalf pursuant to a written contract restricting the third party's use of such data.

3. Information We Collect

3.1 Information You Provide Directly

When you place an order, contact us, or use our Service, we may collect the following categories of Personal Data that you voluntarily provide:

  • Full name
  • Email address
  • Phone number
  • Billing address
  • Shipping address
  • Order details and purchase history
  • Communications you send to us
  • SMS marketing consent and preferences
  • Referral program information

We do not collect Social Security numbers, government identification numbers, or W-9 tax identification information from customers.

3.3 E-Commerce Platform — Shopify

Our online store is hosted and operated on the Shopify Inc. platform. Shopify provides the e-commerce infrastructure that enables us to offer, sell, and fulfill orders for our Products. Your Personal Data, including order information and payment data, may be stored and processed through Shopify's data systems and databases. Shopify processes Personal Data in accordance with its own privacy and security standards. We encourage you to review Shopify's privacy policy at www.shopify.com/legal/privacy.

3.4 Payment Information

Payments are processed through third-party payment processors integrated with our platform, including processors available through Shopify, Wisetack, and HouseCall Pro. We do not store full payment card numbers on our systems. Our payment processors adhere to PCI-DSS standards for secure payment card handling. Any financing arrangements are governed by the applicable third-party financing provider's terms and privacy practices.

3.5 Referral and Affiliate Program Data

If you participate in our Refer & Earn program (powered by UpPromote), we collect information related to your referral activity, including your affiliate link usage, referred transactions, and payout information. UpPromote processes this data in accordance with its own privacy policy. ACH payout information provided for commission payments is handled by UpPromote and is not stored on our primary systems.

4. Cookies and Tracking Technologies

We and our third-party service providers use cookies and similar tracking technologies to operate the Service, analyze usage, and deliver relevant advertising. These include:

  • Essential cookies — necessary for the Website to function
  • Session cookies — temporary cookies that expire when you close your browser

4.2 Your Opt-Out Options

You may limit or opt out of certain cookies and tracking technologies through the following mechanisms:

Please note that opt-outs are browser- and device-specific and may not prevent all data collection by third-party providers operating under their own terms.

5. Purposes for Processing Personal Data

We process Personal Data for the following purposes:

  • Fulfilling and shipping orders for Products, including domestic and international shipments
  • Scheduling and coordinating installation services through independent third-party installers
  • Providing customer service and responding to inquiries
  • Sending transactional communications, including order confirmations, shipping notifications, and warranty documentation
  • Sending marketing communications to customers who have opted in
  • Sending SMS marketing messages to customers who have provided consent (see Section 6)
  • Conducting targeted advertising campaigns through Meta, Google, Pinterest, and other platforms
  • Operating the Refer & Earn affiliate program and processing referral commissions
  • Processing payments and managing financing arrangements with third-party providers
  • Detecting and preventing fraud, unauthorized transactions, and security threats
  • Analyzing and improving our Products, Website, and Services
  • Complying with applicable legal obligations, including tax and accounting requirements
  • Enforcing our agreements, policies, and legal rights

6. SMS Marketing — TCPA Compliance

If you opt into SMS marketing communications from E-Z Storage LLC, the following terms apply:

  • Message frequency varies. You may receive order updates, promotional offers, installation scheduling reminders, and referral program information.
  • Message and data rates may apply, depending on your mobile carrier and plan.
  • Consent to receive SMS marketing is NOT a condition of purchase. You may purchase our Products without opting into SMS communications.
  • You may opt out of SMS communications at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent.

  • We comply with the Telephone Consumer Protection Act (TCPA) and all applicable state SMS marketing laws.
  • We maintain records of SMS opt-in consent where required by applicable law.

7. Email Marketing — CAN-SPAM Compliance

We may send marketing emails to customers who have opted in to receive them. Each marketing email will include a clear and conspicuous unsubscribe mechanism. You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by contacting us at contact@EZGarageStorageUSA.com. Opt-out requests will be honored within ten (10) business days. We comply with the CAN-SPAM Act and all applicable email marketing regulations.

8. Sharing and Disclosure of Personal Data

We do not sell Personal Data for monetary compensation. We may share Personal Data in the following circumstances:

8.1 Service Providers and Processors

We share Personal Data with third-party service providers that process data on our behalf, including Shopify (e-commerce platform), payment processors, email and SMS marketing platforms, analytics providers, advertising platforms, and referral program operators (UpPromote). Such providers are contractually restricted from using Personal Data for purposes other than providing services to us.

8.2 Independent Installers

Where you have purchased Installation Services, we share your name, contact information, property address, and job-specific details (such as ceiling photos and placement preferences) with the independent third-party installer assigned to your job. Installers receive only the information necessary to perform the installation. Installers are subject to confidentiality obligations under the Master Installer Agreement.

8.3 Legal Requirements and Protection of Rights

We may disclose Personal Data if required to do so by applicable law, court order, regulatory requirement, or governmental authority, or where we believe in good faith that disclosure is necessary to protect our legal rights, enforce our agreements, prevent fraud, or protect the safety of any person.

8.4 Business Transfers

In the event of a merger, acquisition, corporate restructuring, sale of all or substantially all assets, or other business transfer, Personal Data may be transferred to the successor entity as a business asset. We will provide notice of any such transfer as required by applicable law.

8.5 Advertising Partners

We may share certain identifiers and interaction data with advertising platforms, including Meta and Google, for purposes of serving targeted advertisements and measuring advertising performance. Certain data sharing with advertising platforms may constitute "sharing" or "Targeted Advertising" under applicable state privacy laws. You may opt out of such sharing as described in Section 4.2.

9. International Shipping and Data Transfers

We ship Products internationally. If you are located outside the United States, your Personal Data may be transferred to, stored in, and processed in the United States and other jurisdictions that may not provide the same level of data protection as your home jurisdiction. By using the Service or purchasing our Products, you consent to such transfer. Where applicable law requires, including for transfers from the European Economic Area (EEA) or United Kingdom (UK), we implement appropriate transfer safeguards, such as Standard Contractual Clauses approved by the European Commission or other mechanisms recognized under applicable law.

10. Data Retention

We retain Personal Data only for as long as is reasonably necessary to fulfill the purposes described in this Policy, comply with applicable legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by data category:

  • Transaction and order records: retained for the period required by applicable tax, accounting, and commercial law (typically seven years or as required by Arizona law)
  • Customer communications: retained for the duration of the customer relationship and a reasonable period thereafter
  • Marketing data: retained until opt-out or as required by applicable law
  • Installer job records: retained for the duration of any applicable warranty period and the period necessary to defend potential legal claims
  • Analytics and advertising data: retained in accordance with the applicable third-party provider's data retention policies

11. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, disclosure, alteration, and destruction. These safeguards include:

  • Encrypted connections (HTTPS/TLS) for data transmission
  • Role-based access controls limiting employee access to Personal Data
  • Secure third-party hosting infrastructure provided by Shopify and other enterprise service providers
  • Regular review of our security practices and procedures

No method of transmission over the internet or electronic storage system is completely secure. We cannot guarantee absolute security of your Personal Data. To the extent permitted by applicable law, we disclaim liability for unauthorized access to or disclosure of Personal Data that occurs despite our reasonable security measures.

12. Data Breach Response

In the event of a confirmed data breach affecting Personal Data, we will:

  • Investigate the breach promptly and take appropriate remedial action
  • Notify affected individuals as required by applicable federal and state data breach notification laws
  • Notify relevant regulatory authorities where required by applicable law
  • Implement corrective measures reasonably designed to prevent recurrence

13. U.S. State Privacy Rights

Residents of certain U.S. states, including California, Virginia, Colorado, Connecticut, Utah, and Nevada, may have specific privacy rights with respect to their Personal Data under applicable state law. These rights may include:

14. California Privacy Rights — CCPA / CPRA

California residents have specific rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). In addition to the rights described in Section 13, California residents may:

  • Request that we disclose the categories and specific pieces of Personal Data we have collected about you
  • Request deletion of Personal Data, subject to exceptions under California law
  • Request correction of inaccurate Personal Data
  • Opt out of the Sale or Sharing of Personal Data, including for cross-context behavioral advertising purposes
  • Limit the use and disclosure of Sensitive Personal Data to purposes specified by California law
  • Not be discriminated against for exercising CCPA/CPRA rights

We do not sell Personal Data for monetary compensation. Certain data sharing with advertising platforms for targeted advertising purposes may constitute "sharing" under California law. We will process verified opt-out requests within fifteen (15) business days. We will respond to all CCPA/CPRA requests within forty-five (45) days, which may be extended by an additional forty-five (45) days where reasonably necessary with prior notice.

15. Global Privacy Control (GPC)

Where legally required and technically feasible given our platform and third-party integrations, we endeavor to honor recognized Global Privacy Control (GPC) browser signals as an opt-out request from the Sale or Sharing of Personal Data. The technical implementation of GPC on e-commerce platforms hosted by third parties may vary. Residents of states that recognize GPC as a valid opt-out mechanism may also submit opt-out requests directly as described in Section 13.

16. Nevada Residents

Nevada residents may submit a request to opt out of the sale of covered information under the Nevada Revised Statutes Chapter 603A. We do not sell covered information as defined under Nevada law for monetary compensation. Nevada residents may direct opt-out requests to contact@EZGarageStorageUSA.com.

17. Children's Privacy

The Service is not directed to, and we do not knowingly collect Personal Data from, children under the age of thirteen (13). If we become aware that we have inadvertently collected Personal Data from a child under thirteen, we will take prompt steps to delete such information from our systems. If you believe a child under thirteen has provided us with Personal Data, please contact us immediately at contact@EZGarageStorageUSA.com.

18. Automated Processing and Artificial Intelligence

We and our service providers may use automated tools and artificial intelligence technologies to analyze website usage, detect fraud, improve marketing performance, and assist with installer recruitment and customer communications. We do not use automated decision-making that produces legal or similarly significant effects on individuals without meaningful human review and involvement. Our use of AI tools, including for purposes such as call transcription (JustCall), lead management (ActiveCampaign), and installer outreach, is limited to operational efficiency and does not substitute for human judgment in material decisions.

19. Third-Party Websites and Links

The Service may contain links to third-party websites, platforms, and services, including UpPromote, SendJim, Wisetack, HouseCall Pro, and social media platforms. These third-party sites operate independently and are governed by their own privacy policies. We are not responsible for the privacy practices, content, or security of any third-party website. We encourage you to review the privacy policies of any third-party site you visit.

20. Corporate Transactions

If E-Z Storage LLC undergoes a merger, acquisition, reorganization, bankruptcy, dissolution, or sale of all or substantially all of its assets, Personal Data may be transferred to the acquiring entity or successor as a business asset, subject to applicable legal requirements. We will provide reasonable notice of any such transfer and any resulting material changes to this Policy.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Company disclaims liability for: (a) any indirect, incidental, consequential, or punitive damages arising from unauthorized access to or disclosure of Personal Data; (b) any misuse of Personal Data by third-party service providers, advertising platforms, or other parties acting outside the scope of our instructions; and (c) any data breach or security incident beyond our reasonable control. Nothing in this Section waives any rights that are non-waivable under applicable federal or state law.

22. Changes to This Policy

We reserve the right to update or modify this Policy at any time. When we make material changes, we will update the "Last Updated" date at the top of this Policy and post the revised Policy on our Website. Where required by applicable law, we will provide additional notice of material changes, such as a prominent Website notice or email notification. Your continued use of the Service following the posting of any changes constitutes your acceptance of the revised Policy.
