SMS Opt-In Disclosure — For Use on Website Opt-In Forms
The following disclosure language must appear on all website forms and checkout pages that collect phone numbers for SMS marketing purposes. Display this text in close proximity to the phone number input field and the opt-in checkbox.

1. Purpose and Scope
This SMS Consent & Disclosure document establishes E-Z Storage LLC's ("Company") compliance framework for text message (SMS and MMS) marketing communications sent to customers and prospective customers under the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all applicable state SMS marketing laws, including but not limited to the California Invasion of Privacy Act (CIPA) and applicable state consumer protection statutes.
2. Opt-In Consent Requirements
E-Z Storage LLC obtains prior express written consent before sending any promotional or marketing SMS messages. This consent is obtained through:
- A clearly labeled opt-in checkbox on our website checkout page and contact forms (checkbox must not be pre-checked)
- A written opt-in disclosure displayed in immediate proximity to the checkbox that identifies the sender, describes the types of messages to be sent, states message frequency, discloses that message and data rates may apply, states that consent is not a condition of purchase, and provides opt-out instructions
- Double opt-in confirmation via SMS reply where required or implemented
- Verbal consent obtained by sales personnel (BJ), confirmed in writing via JustCall call recording
Consent records, including timestamp, IP address, phone number, and opt-in method, are stored in ActiveCampaign and retained for a minimum of four (4) years or as required by applicable law.
3. Types of SMS Messages We Send
With appropriate consent, E-Z Storage LLC may send the following categories of text messages:
- Transactional messages: order confirmations, shipping notifications, delivery updates, installation scheduling and appointment reminders, warranty information
- Marketing messages: promotional offers, new product announcements, seasonal discounts, bundle deals
- Referral program communications: referral link sharing, commission notifications, affiliate program updates
- Customer service messages: follow-up after installation, satisfaction check-ins, review requests
Transactional messages related to an order or installation appointment may be sent without separate marketing opt-in under applicable law. Marketing messages require prior express written consent.
4. Opt-Out — Honoring STOP Requests
STOP Request Handling — Required Compliance Steps
When a recipient replies STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT:
- We must immediately cease all SMS communications to that number
- A single confirmation message must be sent acknowledging the opt-out
- The number must be added to our suppression list in ActiveCampaign within 24 hours
- The suppression must be maintained indefinitely — re-opting in requires fresh consent
Confirmation message text: "You have been unsubscribed from E-Z Garage Storage text messages. No further messages will be sent. Reply START to resubscribe at any time."
Opt-out requests received through any channel — including phone call, email, or written request — must also be honored within 10 business days and reflected in ActiveCampaign.
5. Help Responses
When a recipient replies HELP to any SMS message, we must respond with a message identifying the sender and providing contact information.

6. Message Frequency and Rates Disclosure
The following disclosures must appear in all opt-in consent language and are required by the TCPA and applicable carrier guidelines:
- "Message frequency varies" — our message frequency is not fixed and may vary based on order activity, installation scheduling, and promotional activity
- "Message and data rates may apply" — standard carrier rates apply to all messages received
- "Consent is not a condition of purchase" — customers may purchase our products without opting into SMS communications
7. Do Not Call and Do Not Text Compliance
7.1 E-Z Storage LLC does not send unsolicited marketing SMS messages to numbers registered on the National Do Not Call Registry (DNCR) unless the recipient has provided prior express written consent that supersedes the DNCR registration.
7.2 Internal Do Not Contact lists are maintained in ActiveCampaign. Any customer who has opted out of SMS communications or requested no contact must be flagged in ActiveCampaign and excluded from all outgoing SMS campaigns.
7.3 Sales personnel (BJ) and Suzanne are prohibited from sending marketing SMS messages from personal phone numbers. All SMS communications must originate from Company-approved numbers configured through JustCall.
8. Record Keeping
E-Z Storage LLC maintains the following records in compliance with TCPA requirements:
- Consent records: timestamp, phone number, opt-in method, IP address (for web opt-ins), stored in ActiveCampaign
- JustCall call recordings where verbal consent is obtained
- Suppression lists (opt-outs) maintained indefinitely
- Message logs: records of all outgoing SMS messages including content, recipient, date, and time
- HELP and STOP response records
All SMS consent and communication records shall be retained for a minimum of four (4) years, or such longer period as required by applicable law.
9. Staff Training Requirements
All personnel who collect phone numbers or send SMS communications on behalf of E-Z Storage LLC (including BJ and Suzanne) must be familiar with:
- The requirement to obtain prior express written consent before sending any marketing SMS
- How to properly log consent in ActiveCampaign
- How to honor STOP requests immediately
- The prohibition on sending marketing SMS from personal devices or non-Company numbers
- The rule that consent is never a condition of purchase
